Terms of Service

Last updated: 2026-05-03. These terms apply to your use of the AtoC Korea, LLC platform and are intended to comply with applicable law in the Republic of Korea and the United States.

1. Agreement to Terms

These Terms of Service ("Terms") are a binding agreement between you ("User," "you," "your") and AtoC Korea, LLC ("Company," "we," "us," "our"), a Wyoming limited liability company. By accessing or using our website atockorea.com, our booking platform, mobile experience, or related services (collectively, the "Platform"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may be communicated by email or a prominent notice on the Platform. Continued use after the effective date of changes constitutes acceptance of the revised Terms. If you are a consumer in a jurisdiction that requires explicit consent to amended terms, we may seek such consent where applicable.

You represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into this agreement. If you are booking on behalf of others, you represent that you have authority to bind them and that they agree to these Terms.

2. Definitions

  • Platform means the website, apps, and related systems operated by the Company for browsing and booking tours and activities.
  • Service(s) means the intermediation services we provide (listing tours, processing reservations, facilitating payments when we offer such option, and facilitating communication between Users and Tour Providers).
  • Tour Provider (also "Operator," "Merchant") means the independent third party that operates the tour, activity, or experience. Tour Providers are not employees or agents of the Company.
  • Booking means a reservation you make through the Platform for a tour or activity supplied by a Tour Provider.
  • Tour Service means the actual tour, activity, or experience delivered by the Tour Provider.
  • Platform Fees means fees we charge for our intermediation services (e.g., reservation processing, payment handling, administrative services).
  • Tour Fees means amounts paid for the Tour Service, which we or our designated payment provider collect on behalf of the Tour Provider (minus our Platform Fees and any applicable payment processor fees when we use a third-party processor).

3. Nature of Our Service: We Are an Intermediary Only

We operate solely as a booking intermediary. We do not operate tours, employ guides or drivers, or provide the actual travel, tour, or experience services. We provide a technology platform that allows you to discover and book tours and activities offered by independent Tour Providers. The contract for the Tour Service is between you and the Tour Provider; we facilitate the transaction and, when we offer online payment, facilitate payment through our chosen payment provider(s) and pass relevant information to the Tour Provider for fulfillment.

Responsibility for the execution, safety, quality, timing, and content of the Tour Service lies with the Tour Provider. We are not responsible for the Tour Provider's acts, omissions, representations, or policies. This does not exclude or limit our liability where it cannot be excluded or limited under applicable law (e.g., certain consumer protection laws in Korea or the United States).

Listings on the Platform are based on information provided by Tour Providers. We do not guarantee the accuracy, completeness, or legality of listings or the conduct of Tour Providers. You use the Platform and enter into Bookings at your own risk, subject to these Terms and any applicable cancellation/refund policies disclosed at the time of booking.

Tour Providers listed on the Platform are independently licensed Korean travel agencies that we vet through a verification process covering business registration, insurance coverage, guide certifications, and ongoing operational quality reviews. We may suspend or remove a Tour Provider at any time if our standards are not maintained.

4. Account Registration and Eligibility

To make a Booking or use certain features, you may need to register an account. You agree to provide accurate, current, and complete information and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

We may suspend or terminate your account if you breach these Terms or for other legitimate reasons (e.g., fraud, abuse, or as required by law). You may close your account at any time by contacting us; closure does not affect obligations already incurred (e.g., payment for a Booking already made).

5. Bookings

When you make a Booking, you are making an offer to contract with the Tour Provider for the Tour Service, subject to the price, date, time, and cancellation/refund terms displayed at checkout. A contract for the Tour Service is formed when we (or the Tour Provider) confirm the reservation (e.g., by email or in-app confirmation). We reserve the right to refuse or cancel a Booking (e.g., for pricing errors, fraud, or unavailability) and will refund any payment made if we cancel.

You are responsible for reviewing the product page and confirmation for the correct date, time, meeting point, and any special requirements (e.g., age, health, equipment). Cancellation and refund conditions are set by the Tour Provider and displayed before you complete the Booking; they are also summarized in our Refund Policy.

Prices are displayed in the currency indicated on the Platform (e.g., KRW, USD). Taxes, if any, may be included or added at checkout as required by applicable law. We do not guarantee that prices will not change after you have viewed them; the price at the time you complete the Booking is the binding price unless we have made an error and correct it as permitted by law.

6. Payment Terms

You agree to pay all amounts due at the time of Booking (or as otherwise stated at checkout). When we offer online payment, payment may be processed through third-party payment processors we engage for that purpose. Where card payment is offered, we do not store your full payment card number; card data is handled by the processor in accordance with its terms and applicable payment card standards. By providing payment information in connection with a Booking, you authorize us and any payment processor we use to charge the indicated amount.

Your payment may include Platform Fees and Tour Fees. Platform Fees are generally non-refundable once the Booking is confirmed, except as stated in our Refund Policy. Tour Fees are subject to the Tour Provider's cancellation policy and our Refund Policy. Currency conversion and any fees imposed by your bank or card issuer are your responsibility.

If payment fails or is reversed (e.g., chargeback) in a way that we determine to be inconsistent with these Terms or the applicable cancellation policy, we may cancel the Booking, suspend your account, and pursue recovery of amounts due to the extent permitted by law.

7. Cancellation and Refunds

Cancellation and refund eligibility are governed by (a) the Tour Provider's cancellation policy disclosed at the time of Booking and in your confirmation, and (b) our Refund Policy. We do not override the Tour Provider's policy. To request a cancellation or refund, contact us at support@atockorea.com with your booking reference. Refunds, when approved, will be made to the original payment method within the timeframe stated in our Refund Policy (e.g., 5–10 business days, subject to the payment provider we use for that transaction, if any).

No-show (failure to attend without prior cancellation) typically results in no refund, as stated on the product page and in your confirmation. If the Tour Provider cancels the tour (e.g., weather, safety, insufficient participants), we will work with them to offer a full refund of Tour Fees or an alternative date/experience where possible; Platform Fees may be refunded at our discretion in such cases.

8. User Conduct and Prohibited Uses

You agree not to:

  • Use the Platform for any illegal purpose or in violation of any applicable law or these Terms.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Interfere with or disrupt the Platform, servers, or networks, or attempt to gain unauthorized access to any system or data.
  • Scrape, harvest, or use automated means to collect data from the Platform without our prior written consent.
  • Use the Platform to transmit malware, spam, or harmful or offensive content.
  • Resell or commercially exploit Booking confirmations or Platform content (e.g., tour descriptions) except for your own legitimate booking use.
  • Circumvent our fees or booking process (e.g., contacting Tour Providers to book directly after finding them on our Platform for the purpose of avoiding fees) in a manner that violates these Terms or applicable law.

We may suspend or terminate your access and take other appropriate action (including legal recourse) for breach of this section or any other part of these Terms.

9. Intellectual Property

The Platform and its content (including but not limited to text, graphics, logos, layout, software, and design) are owned by the Company or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without our prior written consent, except for limited personal use (e.g., viewing, printing for your own records). Tour descriptions and images may be provided by Tour Providers; we do not claim ownership of their content but we may display and use it in accordance with our agreements with them.

10. Disclaimers

THE PLATFORM AND OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We do not operate, control, or endorse Tour Providers or Tour Services. Any descriptions, ratings, or other information about tours are for general information only and do not constitute our endorsement or a guarantee of quality, safety, or legality. You assume all risk in choosing and participating in any Tour Service. Where consumer law in your jurisdiction does not allow the exclusion of certain warranties, those exclusions may not apply to you.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • WE (AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL) ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, YOUR BOOKING, OR ANY TOUR SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS, THE PLATFORM, OR OUR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD 100).
  • We are not liable for the acts, omissions, or conduct of Tour Providers, including but not limited to personal injury, property damage, or failure to perform the Tour Service. Any claim arising from the Tour Service itself should be directed to the Tour Provider, subject to applicable law.

Some jurisdictions (including the Republic of Korea and certain U.S. states) do not allow the exclusion or limitation of incidental or consequential damages or of implied warranties, so the above limitations may not apply to you in full. In such cases, our liability will be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Platform, (b) your Booking or participation in any Tour Service, (c) your breach of these Terms or any applicable law, or (d) your violation of any third party's rights. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense.

13. Termination

We may suspend or terminate your access to the Platform and your account at any time, with or without cause or notice, to the extent permitted by law. You may stop using the Platform and close your account at any time by contacting us.

Upon termination, your right to use the Platform ceases. Provisions that by their nature should survive (including Sections 2 (Definitions as used in surviving provisions), 9 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), 14 (Governing Law and Dispute Resolution), and 15 (General)) will survive termination.

14. Governing Law and Dispute Resolution

Governing law: These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law principles. If you are a consumer habitually resident in the Republic of Korea, the mandatory provisions of Korean law may also apply to the extent they cannot be derogated from by agreement.

Disputes: We encourage you to contact us first at support@atockorea.com to resolve any dispute in good faith. If we cannot resolve the dispute within a reasonable time (e.g., 30 days), then:

  • For users in the United States: Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of such courts.
  • For users in the Republic of Korea: You may bring claims in the courts of your place of residence or in the courts of Bucheon-si, Gyeonggi-do, Republic of Korea, as permitted by Korean law. Nothing in these Terms deprives you of the protection of mandatory consumer dispute resolution mechanisms under Korean law (e.g., Korea Consumer Agency, e-commerce dispute resolution).
  • For users in other jurisdictions: Any legal action or proceeding may be brought in the courts of Wyoming or in the courts of your place of residence, as permitted by applicable law.

Where applicable law requires a different governing law or forum for consumer disputes (e.g., EU or Korean mandatory consumer protection), that law or forum will apply to the extent required.

15. General Provisions

Entire agreement: These Terms, together with our Privacy Policy and Refund Policy (and any other policies we reference), constitute the entire agreement between you and the Company regarding the Platform and supersede any prior agreements or understandings.

Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.

Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.

Notices: We may give notice by email to your registered address or by posting on the Platform. You may give notice to us at support@atockorea.com or to our address below.

Force majeure: We are not liable for failure or delay in performance due to circumstances beyond our reasonable control (e.g., natural disaster, war, pandemic, government action, failure of third-party infrastructure).
